General
✦ Beginning the commissioning process means that the client has read through and accepts the terms of service listed✦ My work is NOT permitted for ANY AI or NFT use!! AI generated references / users will be denied service. Adopted designs may NOT be fed into AI!!✦ I am dyslexic so please please please try and keep that in mind!
✧ Paragraphs of text can be hard for me to read, bulletin points or broken up texts are great!✦ Cancellation of service permits me to relist the design. You do not own any rights to the design once service is canceled and may NOT use it as a reference for new designs. Any changes made to the design is owned by me, relisted designs will either be of the original design or after adjusting it into its own design, separate from any unique features the client's preexisting design may have had.✦ My username MUST be clearly credited with the design!! Treat it like you would a vtuber model artist / rigger. I don’t need to be credited everytime but it should be easy to find my name.✦ I am not accountable for ANY actions twitch or any other streaming services may take against you for the design! You will NOT receive a refund if Twitch (or anywhere else) decides the design breaks TOS.
Payment / Refunds
✦ Any payment over $60 can be broken into a 50/50 payment plan. 100% payment is needed to receive the design.
✦ There are no refunds once final payment is received, 50% of what is received can be refunded from a payment plan.
Revisions
✦ For adopts I will do minor revisions for free. Color changes and simple features are included. Complex changes can be added for an additional cost (price varies based on complexity).✦ Please don’t be afraid to ask for changes! I will do anything you ask, I want to make sure you’re happy with the design so please ask!!<3✦ You may make changes of your own once full amount is paid BUT I must still be credited as the designer for the original design.✦ You may NOT draw over / have someone else to draw / trace over my work. You may NOT feed it into any AI.
Use / Intellectual Property Rights
✦ All noncommercial rights and commercial rights for the design are included. The artwork only includes noncommercial rights. (i.e you can use the design to make merch but you cant use the artwork for that merch.) I can explain further if needed.
✦ I am permitted to post WIPS, final products and stream the process unless privacy fee is paid.
✦ I am allowed to use all pieces for my portfolio / as samples.
Resale / Giveaways
✦ I must be informed of giveaways / resale BEFORE anything is listed.
✦ I must still be properly credited by the new owner and they must agree to my TOS.Giveaway :
✦ FREE design giveaways are allowed. Winner MUST accept my TOS and I must still be credited.Adopting with the intent to sell :
✦ You may NOT adopt a design just to resell it! No Vtuber packages, design resales or any other work around to purchase and sell the design.
✦ If you are looking for a design from me to sell / use for a vtuber package look into my custom design cms!Adopting and selling later on :
✦ You may sell the design later on if you no longer wish to use / own it.
✦ You may sell the design alone as long as it does not exceed the amount of the commission! You may NOT add additional fees to get around this, the price the design adds to the sale may NOT exceed the amount paid here!
✦ If the design is sold with additional assets the amount the design adds to the total may not exceed the amount paid for the design.
